These Terms are the agreement between you and Swaree. They also serve as the end-user license agreement (EULA) for the app. Please read them. The “App Store & Apple devices” section below contains terms Apple requires.
Acceptance
By downloading or using Swaree, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the app.
What Swaree is
Swaree is a tool for coordinating get-togethers within private crews. It helps people open a plan and either claim a spot or RSVP. It does not run, host, or guarantee any event, and it is not responsible for what happens at one. You and the other members are responsible for your plans and your conduct.
Eligibility
You must be at least 13 years old to use Swaree. By using the app, you confirm that you meet this requirement.
Your account
You sign in with Apple and are responsible for the activity under your account. Keep your information accurate, and use a name and photo you have the right to use.
Acceptable use
Use Swaree respectfully. You agree not to:
harass, threaten, or harm other members;
post unlawful, infringing, or harmful content;
attempt to break, overload, reverse-engineer, or abuse the service;
use the app for anything illegal.
Hosts and crew admins are responsible for who they invite and what they organize.
Your content
You keep ownership of the content you create. You grant Swaree the permission needed to store and display that content to your crews so the app can function.
Service availability & no warranty
Swaree is provided “as is” and “as available,” without warranties of any kind, whether express or implied. We do not guarantee that plans will fill, that notifications will always arrive, or that the service will be uninterrupted or error-free.
Limitation of liability
To the fullest extent permitted by law, Swaree and its operator are not liable for any indirect, incidental, special, or consequential damages, or for anything arising out of your use of the app or your attendance at any event coordinated through it.
Termination
You can delete your account at any time in Settings. We may suspend or remove access for conduct that violates these Terms.
App Store & Apple devices
The following terms apply because you obtained Swaree through the Apple App Store. Apple requires them, and for App Store use they control over anything inconsistent elsewhere in these Terms.
Acknowledgement. These Terms are between you and Swaree's operator only, and not with Apple. Apple is not responsible for Swaree or its content. These Terms may not be inconsistent with the Apple Media Services Terms and Conditions.
Scope of license. Swaree is licensed, not sold, to you for use only on Apple-branded products that you own or control, and as permitted by the Usage Rules in the Apple Media Services Terms and Conditions (including Family Sharing). The license is non-transferable.
Maintenance and support. We are solely responsible for providing any maintenance and support for Swaree. Apple has no obligation whatsoever to furnish any maintenance or support services.
Warranty. We are solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any) to you; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to Swaree.
Product claims. We, not Apple, are responsible for addressing any claims relating to Swaree, including product liability claims, claims that the app fails to conform to a legal or regulatory requirement, and claims arising under consumer protection or privacy law.
Intellectual property. In the event of any third-party claim that Swaree or your use of it infringes that party's intellectual property rights, we, not Apple, are solely responsible for the investigation, defense, settlement, and discharge of that claim.
Legal compliance. You represent and warrant that you are not located in a country subject to a U.S. government embargo, or designated as a “terrorist supporting” country, and that you are not listed on any U.S. government list of prohibited or restricted parties.

Third-party beneficiary. You acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and that upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
Changes
We may update these Terms as the app evolves. Continued use after an update means you accept the revised Terms.
Governing law
These Terms are governed by the laws of the United States and the state in which Swaree's operator is based, without regard to its conflict-of-law principles.
